Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Mental mobile application (“Mental,” “the App,” “we,” “us,” or “our”), operated by Egor Belotskiy. By downloading, accessing, or using Mental, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an entry, starting a free trial, or otherwise using Mental, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms apply in addition to, and do not replace, Apple’s Licensed Application End User License Agreement where applicable.

2. Description of Service

Mental is a mood-tracking and journaling application. Core functionality includes:

• Two-tap mood check-ins on a 7×7 energy/valence grid
• A journal with trends, tags, calendar views, and a “mood clock”
• Streaks and reminders
• AI-generated daily summaries and reflections (Pro)
• Mirror (Pro) — AI-assisted detection of longitudinal patterns (“chapters”) in your emotional history, which you interpret and name yourself
• The Wager (Pro) — a self-prediction feature where you forecast your own next-day mood and receive an accuracy score. The Wager involves no real-money wagering, betting, or prizes of any kind and is not a game of chance.
• Apple Health integration (Pro, optional) — coarse, bucketed context (e.g., sleep range, step range) used only to inform in-app reflections

No account or sign-in is required. Your data is stored on your device and in your private iCloud account, which we do not have access to.

3. Eligibility

You must be at least 16 years old to use Mental. If you are under the age of majority in your jurisdiction, you may only use Mental with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

4. Not Medical Advice, Not Therapy

Mental is a self-reflection and mood-tracking tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment of any kind.

• Mental’s AI features (including daily summaries, Mirror reflections, and weekly prompts) are designed to observe and reflect patterns in the data you provide. They are never designed to diagnose, and never designed to state or imply anything about your mental health status.
• Nothing in the App is a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical or mental health condition.
• Never disregard professional medical advice or delay seeking it because of something you read or were shown in Mental.

5. Crisis and Emergency Situations

Mental is not a crisis service and is not equipped to respond to emergencies.

If you are experiencing a mental health crisis, having thoughts of self-harm or suicide, or believe you or someone else is in danger, please contact your local emergency services immediately, or reach out to a crisis line in your region. Where appropriate, Mental automatically surfaces verified local support resources based on the patterns in your check-ins — but you should not rely on the App as your sole or primary means of accessing help during a crisis.

6. AI-Generated Content

Certain features of Mental use artificial intelligence (via third-party AI providers, accessed through our own infrastructure) to generate reflections, summaries, and prompts based on the data you enter. You acknowledge that:

• AI-generated content is produced automatically and may occasionally be inaccurate, incomplete, or not reflect your actual circumstances.
• AI-generated content reflects patterns in your logged data only — it does not know you, does not diagnose you, and its output should be read as a prompt for your own reflection, not as a factual or clinical statement about you.
• We do not review AI-generated output before it is shown to you.

7. Subscriptions and Billing

Mental is free to use, with no account and no subscription required. Optional auto-renewing subscriptions unlock additional features and are purchased through your Apple ID account:

• Free trials convert automatically into a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.
• Payment is charged to your Apple ID account at confirmation of purchase and renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellation and refunds are managed entirely through your Apple ID account settings (Settings → [your name] → Subscriptions on iOS). We do not process payments or refunds directly; all billing is handled by Apple in accordance with Apple’s own terms and policies.
• Pricing is shown in US dollars above for reference; the actual price, currency, and any applicable taxes may vary by region and are always shown in the App Store before you confirm a purchase.
• Price changes, if any, will be communicated in advance in accordance with Apple’s guidelines.
• The free tier does not expire. If a Pro subscription lapses or is cancelled, all of your entries remain accessible and the free features above keep working; Pro features — all AI-generated content, Mirror, The Wager, and Apple Health integration — stop until you resubscribe.

8. Your Content and Data

• You retain full ownership of the check-ins, notes, tags, and any other content you create in Mental (“Your Content”).
• Your Content is stored in your private iCloud account (via CloudKit) and, where applicable, transiently processed by third-party AI providers solely to generate the reflections described in Section 6. Full detail on data handling is in our Privacy Policy.
• You are solely responsible for Your Content and for ensuring it does not violate these Terms or any applicable law.
• We do not sell Your Content, and we do not use Your Content for advertising purposes.

9. Acceptable Use

You agree not to:

• Use Mental for any unlawful purpose or in violation of any applicable law
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the App, except where permitted by law
• Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure
• Attempt to gain unauthorized access to any systems or data connected to Mental
• Use automated means (bots, scrapers) to access or interact with the App

10. Intellectual Property

Mental, including its design, branding, features, and underlying software, is the property of Egor Belotskiy and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

11. Termination

You may stop using Mental at any time by deleting the App from your device and cancelling any active subscription through your Apple ID settings. We reserve the right to suspend or terminate access to the App for any user who violates these Terms.

12. Disclaimer of Warranties

MENTAL IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EGOR BELOTSKIY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, MENTAL — INCLUDING ANY RELIANCE PLACED ON AI-GENERATED CONTENT WITHIN THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Egor Belotskiy from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Belarus, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of Mental that cannot be resolved informally shall be subject to the jurisdiction of the competent courts of the Republic of Belarus. Nothing in this section deprives you of the protection of any mandatory consumer-protection rights under the laws of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the App. Continued use of Mental after changes take effect constitutes acceptance of the revised Terms.
